Il recepimento nello scorso agosto della direttiva europea 2009/12/EC, attraverso l’inserimento del “reato ambientale marittimo causato da navi” tra quelli previsti dal D.Lgs. 231/01, si inserisce in una forte domanda di requisiti ambientali addizionali perseguita dal governo degli Stati Uniti e, recentemente, dal Parlamento europeo. In un quadro dove l’implementazione degli strumenti ambientali volontari si sta rivelando determinate per le compagnie di navigazione che incrociano le rotte americane nasce così l’esigenza di razionalizzare la gestione dei sistemi ambientali (EMS). Ignorance of US rules is no defence

Ignorance about current legislation in the US prevents companies from taking proactive steps to avoid problems, delegates were told at a conference on Maritime Environmental Compliance and the US Perspective held in Italy in June. “The lack of correct information about US environmental regulations in force quite often leads to their breach,” noted Michael Minogue, president and CEO of US-based ECM Maritime Services, which organised the event jointly with the Italian P&I broker PL Ferrari. Minogue and his senior vice-president Nishit Kapoor warned the 50 ship owners and managers attending that penalties could affect a company’s very survival.”

Highlighted by the slogan ‘Investigate–Criminalize–Prosecute’, the conference ‘Maritime Environmental Compliance & the US Perspective’ – organised by the international consulting company ECM Maritime Services, LLC (represented by chairman and CEO Michael Minogue and vice-president Nishit Kapoor), and hosted in its Genoese headquarters by the P&I broker PL Ferrari (represented by Massimiliano Villa) – was attended by some fifty shipowners and shipmanagers and provided an insightful overview on the complex and stringent US regulations on maritime pollution.

Full immersion for Carboflotta’s staff

ECM Europe will arrange an intensive seminar aimed at the promotion of Environmental Management System and safety regulations. ECM Europe Srl has signed an agreement with Carboflotta Group of Genoa in order to arrange an intensive 2 day EMS Seminar – to be conducted in 2010 at Carboflotta Training Center in La Spezia – for their senior officers and shore personnel from Italy, aimed at the promotion of Environmental Management System and environmental and safety US Federal and State regulations and requirements for about 60 employees.
